According to Idaho Statute 25-2807, dogs are only property
Dogs are property. And if the value of the dog is material in a civil or criminal proceeding in this state, the same may be established under the normal rules of evidence regarding the value of personal property.
So…who gets the pet?!
Consider a scenario where one spouse financed the dog's adoption while the other served as the primary caregiver.
Arguments can be made from both sides. One emphasizes financial contribution, the other emphasizes care and consideration. Determining rightful ownership can be even more complicated if both spouses jointly contributed to the adoption and maintenance of the pet.
Ultimately, the task of assigning pet custody in Idaho falls to a presiding judge, who considers a variety of factors, including financial investment and caregiving responsibilities. The reaction of each spouse plays a vital role in determining custody.
