California attorney Tracy Cowan represents several couples who are suffering emotionally after learning their chances of having a child have been jeopardized.
“That's exactly what our clients are fighting, given that all of their future children will be wiped out in one blow,” Cowan said.
Mr. Cowan, a partner at the Clarkson law firm, is the lead attorney in several lawsuits against Cooper Surgical, a manufacturer of IVF products in Trumbull.
The company filed three more lawsuits Tuesday in California, where Cooper Surgical's parent company is located.
“Defendants' defective products and negligent conduct destroyed Plaintiff's precious and irreplaceable developing embryo,” the complaint states.
“What went wrong in this situation was that there was a solution. There was a liquid in the petri dish that was supposed to support the embryo's development, but that liquid contained important It was missing nutrients, specifically magnesium,''' Cowan said.
Cowan said the company learned from a customer doctor that there was a manufacturing issue at Cooper Surgical that affected families undergoing IVF at clinics across the country between November and early December of last year.
“You can imagine the great loss it would be for people to know that these children, the fetuses they created that were to become their future children, are lost forever and can never be retrieved.” Cowan said.
Adam Wolf, an attorney at Pifer, Wolf, Kerr, Kane, Conway & Wise, is representing about 60 additional clients, including families in Connecticut.
Mr. Wolf filed two lawsuits against the manufacturers.
“This should never have happened. It is no surprise to Cooper Surgical that lawsuits have been filed and will continue to be filed,” Wolf said.
Cooper Surgical said in a statement:
